നിശബ്ദ പ്രചാരണ കാലയളവിൽ തെരഞ്ഞെടുപ്പ് സംബന്ധിച്ച വിവരങ്ങൾ പ്രദർശിപ്പിക്കുന്നതിനും എക്സിറ്റ് പോളിനും നിരോധനം :കേന്ദ്ര തിരഞ്ഞെടുപ്പ് കമ്മീഷൻ

 

അസം, കേരളം, പുതുച്ചേരി, തമിഴ്‌നാട്, പശ്ചിമ ബംഗാൾ എന്നിവിടങ്ങളിലെ നിയമസഭകളിലേക്കുള്ള പൊതുതിരഞ്ഞെടുപ്പിൻ്റേയും ഗോവ, ഗുജറാത്ത്, കർണാടക, മഹാരാഷ്ട്ര, നാഗാലാൻഡ്, ത്രിപുര എന്നീ സംസ്ഥാനങ്ങളിലെ എട്ട് നിയമസഭാ മണ്ഡലങ്ങളിലേക്കുള്ള ഉപതിരഞ്ഞെടുപ്പിൻ്റേയും സമയക്രമം 2026 മാർച്ച് 15-ന് കേന്ദ്ര തിരഞ്ഞെടുപ്പ് കമ്മീഷൻ പ്രഖ്യാപിച്ചിരുന്നു.

2. 1951-ലെ ജനപ്രാതിനിധ്യ നിയമത്തിലെ വകുപ്പ് 126 (1) (b) പ്രകാരം, ഏതെങ്കിലും പോളിംഗ് ഏരിയയിൽ വോട്ടെടുപ്പ് അവസാനിക്കുന്നതിന് 48 മണിക്കൂർ മുമ്പുള്ള കാലയളവിൽ (നിശബ്ദ പ്രചാരണ കാലയളവ്), ടെലിവിഷൻ വഴിയോ സമാനമായ മറ്റ് ഉപകരണങ്ങൾ വഴിയോ തിരഞ്ഞെടുപ്പ് സംബന്ധമായ എന്തെങ്കിലും പ്രചാരണസാമഗ്രികൾ പ്രദർശിപ്പിക്കുന്നത് നിരോധിച്ചിരിക്കുന്നു.

3. സംസ്ഥാനങ്ങളിലെ തെരഞ്ഞെടുപ്പുകൾ താഴെ നല്കിയിരിക്കുന്ന സമയക്രമം അനുസരിച്ച് നടത്തപ്പെടും:

4. ഇതനുസരിച്ച്, മുകളിൽ സൂചിപ്പിച്ച കാലയളവിൽ ടെലിവിഷൻ/റേഡിയോ ചാനലുകളും കേബിൾ ശൃംഖലകളും സംപ്രേഷണം ചെയ്യുന്ന/പ്രക്ഷേപണം ചെയ്യുന്ന/പ്രദർശിപ്പിക്കുന്ന പരിപാടികളുടെ ഉള്ളടക്കത്തിൽ, ഏതെങ്കിലും പ്രത്യേക രാഷ്ട്രീയ പാർട്ടിയുടേയോ സ്ഥാനാർത്ഥിയുടേയോ വിജയ സാധ്യത പ്രോത്സാഹിപ്പിക്കുന്നതോ മുൻവിധിയോടെ കാണുന്നതോ, അല്ലെങ്കിൽ തെരഞ്ഞെടുപ്പ് ഫലത്തെ സ്വാധീനിക്കുന്നതോ ബാധിക്കുന്നതോ ആയി വ്യാഖ്യാനിക്കാവുന്ന വിവരങ്ങളൊന്നും അടങ്ങിയിട്ടില്ലെന്ന് ഉറപ്പുവരുത്തണമെന്ന് കമ്മീഷൻ ആവർത്തിച്ച് വ്യക്തമാക്കുന്നു. ചർച്ചകളിൽ പങ്കെടുക്കുന്നവരോ പാനലിസ്റ്റുകളോ നടത്തുന്ന അഭിപ്രായപ്രകടനങ്ങളും അഭ്യർത്ഥനകളും ഇതിൽ ഉൾപ്പെടും. കൂടാതെ, വോട്ടെടുപ്പ് ഫലത്തെ സ്വാധീനിക്കുന്നതോ ബാധിക്കുന്നതോ ആയ ഏതെങ്കിലും തരത്തിലുള്ള അഭിപ്രായ സർവ്വേകൾ പ്രദർശിപ്പിക്കുന്നതും ഇതിൽ ഉൾപ്പെടുന്നു.

 

5. 1951-ലെ ജനപ്രാതിനിധ്യ നിയമത്തിലെ വകുപ്പ് 126A പ്രകാരം, 2026 ഏപ്രിൽ 9 (വ്യാഴം) രാവിലെ 7 മണിക്കും 2026 ഏപ്രിൽ 29 (ബുധൻ) വൈകുന്നേരം 6.30നും ഇടയിലുള്ള സമയത്ത് എക്സിറ്റ് പോളുകൾ നടത്തുന്നതും അച്ചടി-ഇലക്ട്രോണിക് മാധ്യമങ്ങൾ വഴി അവയുടെ ഫലങ്ങൾ പ്രചരിപ്പിക്കുന്നതും നിരോധിച്ചിതായി കമ്മീഷൻ അറിയിച്ചു. 1951-ലെ ജനപ്രാതിനിധ്യ നിയമത്തിലെ വകുപ്പ് 126 A ലംഘിക്കുന്നത് രണ്ട് വർഷം വരെ തടവോ പിഴയോ അല്ലെങ്കിൽ ഇവ രണ്ടും കൂടിയോ ലഭിക്കാവുന്ന കുറ്റമാണ്.

 

6. എല്ലാ മാധ്യമ സ്ഥാപനങ്ങളും ഈ മനോഭാവം ഉൾക്കൊണ്ട് ഇക്കാര്യത്തിൽ നല്കിയിട്ടുള്ള നിർദ്ദേശങ്ങൾ പൂർണ്ണമായ അർത്ഥത്തിൽ പാലിക്കണമെന്ന് കമ്മീഷൻ നിർദ്ദേശിച്ചു.

 

General Elections and bye-elections 2026: Prohibition of display of Election Matter in Silence Period and Exit Poll

Election Commission of India (ECI) announced the schedule for the General Election to Legislative Assemblies of Assam, Kerala, Puducherry, Tamil Nadu and West Bengal and Bye-election to 8 (Eight) Assembly Constituencies of Goa, Gujarat, Karnataka, Maharashtra, Nagaland and Tripura on March 15, 2026.
Section 126 (1)(b) of the Representation of the People Act, 1951, prohibits displaying any election matter by means, inter alia, of television or similar apparatus, in any polling area during the period of forty-eight hours (silence period) ending with the hour fixed for the conclusion of the poll for any election in that polling area.

Accordingly, the Commission reiterates that the TV/Radio channels and cable networks should ensure that the contents of the programme telecast/broadcast/displayed by them during the period mentioned above do not contain any material, including views/appeals by panellists/participants that may be construed as promoting/prejudicing the prospect of any particular party or candidate(s) or influencing/affecting the result of the election. This includes display of any opinion poll.
The Commission under Section 126A of the R.P. Act 1951, has notified that the conduct of Exit poll and dissemination of their results by means of print or electronic media is prohibited between 7:00 AM on April 9, 2026 (Thursday) and 6.30 PM on April 29, 2026 (Wednesday). Violation of Section 126A of the R.P. Act, 1951 is punishable with imprisonment upto a period of two years, or with fine or both.
The Commission advises all Media houses to follow instructions in this regard in keeping with its spirit.
